QUESTION NO.11: - HOW TO OBTAIN LICENCE?
Answer: - An occupier of a factory is required to obtain a Licence under the provisions of rule 4 of the Delhi Factories Rules, 1950. For this purpose he is required to make an Application to the Office of the Directorate of Factories, in accordance with the provisions of these rules.
QUESTION NO.12: - WHAT ARE THE DOCUMENTS TO BE SUBMITTED FOR GRANT OF LICENCE?
Answer: - Such an application along with a forwarding letter should be accompanied by the following documents;

Fee as per Schedule appended below rule 5 is required to be paid in State Bank of India, Old Secretariat, Delhi. The applicant is required to fill-up Treasury Challan (T.R.6) in triplicate and get the Head of Account endorsed from the office of the Director of Factories. Thereafter the requisite fee is required to be paid in State Bank of India, Old Secretariat, Delhi. The Original Receipt (T.R.6) given by the Bank is required to be submitted to the office of the Director of Factories. All such applicants are advised to retain a photocopy of this Receipt for payment of fees, with them before depositing the Original Receipt in the office.

A copy of the Plan approved as per provisions of the rule 3A of the Delhi Factories Rules, 1950.

A copy of Municipal Trade and Power Licence or proof of connected power load.

A copy of the Consent required to be obtained from Delhi Pollution Control Committee, under the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. |

A copy of the 'nomination of occupier by all the partners in case of Partnership Company and by the Board of Directors, in case of Private/Public limited Company. In case of Partnership Company, a copy of Partnership Deed and in case of Private/Public Limited Company, a copy of the Memorandum and Article of Association of the Firm, along with a List giving names and addresses of all the Directors is also required to be submitted. However, in case of a factory owned or controlled by Central Government, State Government of Local Authority, a copy of Nomination of occupier by the Appropriate Government/ Authority, is required to be submitted. |

Health and Safety Policy, prepared in accordance with the provisions of rule 61-G of the Delhi Factories Rules, 1950, is also to be submitted by factories engaged in hazardous process. |
All such applications are scrutinized at the level of district Deputy Director of Factories and in case any defect is noticed the same is communicated to the applicant through a letter, pointing out the defects. After the application is complete in all aspect, the factory premises are inspected by the Director of Factories or by Deputy Director of Factories or Assistant Director of Factories to assess suitability for grant of Licence. If factory conforms to the statutory requirements, the licence is granted by the Director of Factories in prescribed Form No.4. |
QUESTION NO.13: - WHETHER ANY FEE IS REQUIRED TO PAY?
Answer: - Yes, fee is payable as per Schedule appended below rule 5 of the Delhi Factories Rules, 1950.
QUESTION NO.14: - WHOM TO CONTACT FOR GRANT OF LICENCE?
Answer: - The Applicant may contact the district Deputy Director of Factories at the Headquarters. However, in case the concerned Deputy Director of Factories is not available in the office or the applicant is not satisfied with the clarification given by the concerned Deputy Director of Factories he may contact Director of Factories.
QUESTION NO.15: - WHAT IS THE VALIDITY OF LICENCE GRANTED?
Answer: - The Licence is valid up to 31st December of the year in which it has been granted.
