PROCEDURE FOR RENEWAL OF LICENCE
A licence granted under the provisions of Rule 5 of the Delhi Factories Rules, 1950 is required to be renewed as per provisions of Rule 7 of the said Rules.
Q1. How to apply for renewal?
Ans. An application for renewal of licence is required to be made to the Directorate of Industrial Safety & Health, Labour Department, Govt. of NCT of Delhi, D-Block, Second Floor, 5, Sham Nath Marg, Delhi-110054.
Q2. What are the documents to be submitted for renewal of a licence?
Ans. The following documents are required to be submitted along with a forwarding letter for renewal of a licence: -
- Form No.2 in triplicate, duly filled-in and complete in all respects.
- Fees for renewal of licence which is same as for grant of licence and procedure for payment of fee for renewal is same as that of grant of licence. The original receipt in GAR-7 is to be enclosed with the applications. Please refer FEE SCHEDULE.
- Original licence, for endorsement of renewal. Please keep in mind that laminated licence will not be accepted and the management has to request for issue of duplicate licence by depositing Rs. 100/- in GAR-7 as a fees in addition to the renewal fees for duplicate licence in such cases.
Q3. Can a licence be renewed for more than one year at a time?
Ans. Yes, a factory occupier may get the licence renewed either for one, five or ten years at a time. In case application for renewal has been made for five or ten years, the renewal fee shall be five or ten times the fee payable specified in the Fee Schedule as the case may be. Q4. When an application is to be submitted for renewal?
Ans. An application for renewal of licence complete in all respects is required to be made in advance delivered in the Directorate of Industrial Safety & Health at least 30 days before the due date of expiry of the licence, which is 31st December of the calendar year upto which the licence has been granted/renewed/applied for renewal. It implies that the application must reach in the office upto 30th November of the calendar year, in which the licence expires.
Q5. Whether any late fee is payable, in case application for renewal is not submitted in time?
Ans. Yes, a late fee @25% of the fee payable for a calendar year is charged wherein the application for renewal has been submitted in office after expiry of the time limit; i.e., after 30th November of the calendar year in which the licence expires. Please note that the date of submission of application in this office shall be treated for the calculation of late fee.
Q6. What is the procedure for renewal of licence?
Ans. If an application complete in all respects along with the prescribed fee has been submitted in the Directorate of Industrial Safety & Health, a licence is renewed by the Deputy Director (ISH) and thereafter the same is returned to the concerned factory, along with a forwarding letter under registered/speed post.
